Kalmbach Feeds® Photo Contest Terms & Conditions 2025

NO PURCHASE NECESSARY TO ENTER OR WIN. INTERNET ACCESS IS REQUIRED TO ENTER. CONTEST IS OFFERED ONLY IN THE UNITED STATES. Void where prohibited or restricted by law. The Kalmbach Feeds® Photo Contest (“Contest”) begins on Wednesday, July 30, 2025 and ends at 11:59:59 p.m. (ET) on Wednesday, August 6, 2025 (“Contest Period”). The Contest is sponsored by Kalmbach Feeds® Inc., 7148 State Hwy 199, Upper Sandusky, OH 43351 (“Sponsor”).

ELIGIBILITY: the Contest is open to individuals who are age 18 or older at the time of entry and U.S. legal residents that reside in  the forty-eight contiguous United States and District of Columbia (excluding Alaska and Hawaii). Employees, suppliers, officers and directors of Sponsor, as well as their parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment agencies, legal advisors, immediate family members, and persons living in the same household of such persons are not eligible to participate in the Contest. Additional restrictions may apply.  All participants entering the Contest agree to be bound by the terms and conditions set forth herein.

ENTRY: To enter, visit Kalmbach Feeds Photo Contest to submit the Kalmbach Feeds® Photo Contest entry form. Website entries must be received by 11:59:59 p.m. ET on Wednesday, August 6, 2025 and tracked by Kalmbach Feeds®. Limit one entry per person. You may enter the Contest under one name and one email address only. Only use an email address subscribed and registered in your name. In the event of a dispute as to entries submitted by multiple individuals using the same email account, entry will be deemed to have been submitted by the authorized subscriber of the email account used to enter the Contest at the actual time of entry. The authorized email account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Entries generated by script, macro, robotic, programmed, AI, or any other automated means are prohibited and will be disqualified. An eligible individual receives one automatic entry into the Contest when he/she submits the requested information. The email address submitted must be valid at the time of Contest entry and at the time of Prize drawing. All entries shall become the property of Sponsor.  If you upload an image as part of your entry you are representing that you have full ownership rights in such image, and you hereby give Sponsor an unlimited, irrevocable license to use such images for purposes of promoting the Contest, including without limitation the reproduction, display, and dissemination of the image on Sponsor’s marketing materials.  You also represent that no individual, with the exception of yourself (if you so choose), is included in such image, and that if you are included in the uploaded image you waive all right of publicity and/or privacy and acknowledge that Sponsor may utilize the image as provided for promoting the Contest.  You agree to indemnify Sponsor for any claim of infringement, actual of threatened, made by any third party regarding such image, or any dispute arising from publicity and/or privacy rights associated with any individual included in the image.  

PRIZE: Winner(s) will win 1 (one) prize consisting of one (1) free bag of Kalmbach Feeds® branded animal feed of winner’s choice. Kalmbach Feeds, Inc. shall provide and ship the feed to the winner at the address submitted in the Entry or otherwise directed by winner in writing to Sponsor. The prize can only be shipped to a location within the contiguous 48 states. Sponsor cannot ship the prize to PO boxes. All prize details are ultimately at the Sponsors’ discretion. No cash or other prize substitution permitted except at Sponsors’ discretion. The prize is nontransferable.  

 

SELECTION OF WINNER: The winner will be determined by random drawing from all eligible entries received, to be held on or about Thursday, August 7, 2025. The odds of winning depend on the number of eligible entries received. Within five (5) business days of the drawing, the potential winner will be notified via the email address provided upon entry. Sponsors are not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify potential winners. By accepting and/or using the prize, Winner consents to the use of his/her names, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law and upon request will provide such consent in writing. Winner, by their participation, and any heirs, executors, administrators and assigns, hereby releases and forever discharges Sponsor, their employees, officers, directors, and agents from any and all claims arising out of or in any way connected with the use of his/her names, voice and/or likeness now and in the future. Sponsor will determine in their sole and absolute discretion whether or not the winner’s name, voice and/or likeness shall be used in any manner. If the selected winner cannot be contacted, is ineligible or fails to claim the prize within fifteen (15) days from the time award notification was sent to the email provided in the entry, the prize may be forfeited, and an alternate winner selected. Winner shall assume any and all responsibility as to federal, state, or local taxes in connection with the prize, as well as any other costs and expenses associated with the acceptance and/or use of the prize not specified herein as being provided.

RELEASE:  By participating in the Contest, participant agrees to release Sponsor and any other persons or entities associated with the sponsorship, fulfillment, administration, prize, advertising, or promotion of the Contest, and each of their parent companies, affiliates, subsidiaries, advertising and promotion agents, and their officers, directors, employees, agents, and representatives, as well as their successors, representatives, and assigns, from any and all actions, claims, injury, loss, or damage arising in any manner, directly or indirectly, in whole or in part, from participating in this Contest and/or acceptance, use, or  misuse of the prize.  Participant agrees, in the event that they are the winner, to release Sponsor from any claim of harm, injury, or damages associated with the receipt, use, possession, storage, installation and/or maintenance of any part of the prize.

Participant holds all responsibility to comply with any applicable federal, state or local laws in connection with their entry and use of any prize awarded. The receipt by the winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

GENERAL TERMS AND CONDITIONS: By entering, participant agrees (a) to be bound by these Official Rules and the decisions of Sponsor, which shall be final, and (b) that Sponsor, agents and representatives of Sponsors, their parent companies, affiliates, subsidiaries, officers, directors, employees, legal advisors and advertising, promotion, fulfillment agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, installation, setup, maintenance, or use of the prize, or from participation in the Contest including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the Contest. Sponsor reserves the right, in its sole discretion, to modify, suspend, or cancel the Contest at any time if the Contest is not capable of running as planned, including if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest. Sponsor reserves the right at its sole discretion to disqualify any individual or entity it finds to be attempting to defraud or in any way tamper with the Contest. The decisions of Sponsor concerning any and all matters with respect to this Contest shall be final.

APPLICABLE LAW: THIS CONTEST AND OFFICIAL RULES ARE GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF OHIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ohio having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participants’ actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.

WINNERS’ LIST AND OFFICIAL RULES: To obtain a copy of the winner’s name or a copy of these Official Rules, mail your request along with an enclosed stamped, self-addressed envelope to: Kalmbach Feeds, Inc., 7148 State Hwy 199, Upper Sandusky, OH 43351. Requests must be received no later than Friday, August 15, 2025.

Any information you provide is given to Sponsor and not the Social Media Platforms. Participants release the Social Media Platforms from any liability in connection with this Contest.
